Marke2ing Ltd: GDPR Policy

1.Introduction

The General Data Protection Regulation (GDPR) comes into force on 25 May 2018 and represents a major overhaul of the data regulatory framework in Europe and introduces new obligations which we must all adhere too.

Marke2ing holds various forms of personal information including personal data relating to its employees and other personnel engaged by Marke2ing as well as the personal data relating to the services that Marke2ing provides to its clients.

This policy sets out how Marke2ing will protect personal data and ensure that all those employed and engaged by Marke2ing understand the rules governing the use of personal data and to which they have access during their work for Marke2ing.

Within Marke2ing, the person that has responsibility for GDPR implementation and compliance is our Director, Linsay Duncan.  Any questions relating to this policy should be addressed to the Linsay Duncan.

2. Scope

This policy applies to all those that are employed or engaged to work at Marke2ing.

Additional policies and guidelines may apply from time to time. The relevant policies are available from the Linsay Duncan.

3. Our Data Processing Activities

From time to time Marke2ing shall carry out an assessment of what personal data it collects, stores and processes and where necessary shall update its policy and ensure it has adequate security in place for the storage and processing of personal data.

4. The Rights of Individuals

We acknowledge that individuals have the following rights:

  • The right to be informed;
  • The right of access;
  • The right to rectification;
  • The right to erasure;
  • The right to withdraw consent;
  • The right to restrict processing;
  • The right to data portability;
  • The right to object; and
  • Rights in relation to automated decision making and profiling.

If an individual makes a request that one or more of these rights is exercised and the relevant conditions are met, Linsay Duncan must be informed immediately that such a request is made.  We will acknowledge the request promptly and shall review and provide a detailed response within one (1) month of the request being received. These requests need to be addressed carefully and you must always notify Linsay Duncan if such a request is made and before any communication is made with the individual.

5. Our Privacy Policy

It is very important that we inform people as to why their data is being collected and processed and who we might share it with. Marke2ing shall update its privacy policy with the following information:

  • Our details so that the individual knows who is the data controller;
  • What information is being collected?
  • Who is collecting it?
  • How it is collected?
  • Why is it being collected?
  • How it will be used?
  • Who it will be shared with?
  • Details of transfers to third country and safeguards
  • Retention period

It is important that we always obtain explicit consent from data subjects to collect and process their personal data.

6. Sensitive Data and Children

The nature of the services carried out by Marke2ing means that from time to time we may collect sensitive data and therefore we must ensure enhanced measures are in place to keep such data secure as well as obtaining the explicit consent of the individual to collect and process it.

Marke2ing does not collect the personal data of children (individuals under the age of 16 years).

7. How long do we hold data for?

Marke2ing shall not hold data any longer than is necessary for its legitimate interests and shall minimise the amount of data it holds and collects regarding data subjects wherever possible.

With respect to the personal data we hold we shall hold the data during their engagement with Marke2ing and afterwards for as long as is reasonably necessary.

With respect to personal data relating to those who apply to be employed or engaged by Marke2ing if the individual is unsuccessful then we shall delete or, in the case of hard copies, destroy the personal data of an unsuccessful individual as soon as is reasonably practicable.

A successful individual’s personal data shall be held in electronic format only.

When an individual’s employment or engagement is terminated for whatever reason their personal data shall be deleted as soon as is reasonably practicable.

8International Transfers

Marke2ing does not generally transfer outside the European Economic Area (EEA) and should this be necessary it will ensure that it enters into the appropriate standard contractual clauses governing such transfers.

9. What happens if there is a Data Breaches

In the event of an actual or suspected data breach or if you have any concerns regarding the handling of personal data within our business, you must notify Linsay Duncan immediately.  Marke2ing must notify the relevant Data Protection Authority with 72 hours of any actual or suspected breach.
